In a recent development in Nairobi’s legal scene, Luis Borura Nyawira and Stephen Wafula Okoni find themselves entangled in a serious legal battle after being accused of breaking into a building and committing a felony.

The Charges

The duo appeared before Magistrate Robinson Ondieki to face charges of breaking into a building and committing a felony against the law.

Denial of Charges

Both Luis Borura Nyawira and Stephen Wafula Okoni adamantly denied the charges brought against them during the court proceedings.

Details of the Alleged Crime

According to the charges, on April 1, 2024, along Biashara Street within Nairobi CBD, the accused, along with others not present in court, allegedly broke into Hilson Plaza, specifically floor shop no. 1, Quebec gaming. The stolen items include nine PlayStations, two PlayStation consoles, twenty PlayStation pads, and thirty-five gaming disks, valued at a total of Sh 1,260,000, belonging to Anthony Mwendwa Kinoti.

Legal Proceedings

Lawyer Dunstan Omari, representing the victim, urged the court to mandate the removal of facial masks worn by the accused for proper identification. Additionally, he expressed his support for the prosecution’s application to oppose bail for the accused.

The victims’ lawyer emphasized the importance of identifying the accused properly to ensure a fair trial and bring justice to the victim.

Support for Prosecution’s Application

In a bid to ensure that justice prevails, the prosecution sought to oppose bail for the accused, citing the severity of the alleged crime and the need to prevent potential accomplices from fleeing justice.

Request for Bail

Contrary to the prosecution’s stance, the accused requested to be released on bond, assuring the court of their commitment to comply with the legal proceedings.

Opposition to Bail

However, the Director of Public Prosecutions (DPP) expressed opposition to granting bail or bond, presenting an affidavit citing concerns about potential accomplices and the need to maintain law and order.

Awaiting Court’s Ruling

The fate of Luis Borura Nyawira and Stephen Wafula Okoni hangs in the balance as the court is set to deliver its ruling on the matter tomorrow.
