Jeremiah Tukuo and Gilbert Loishorua face legal scrutiny after being charged in a Kajiado court for the alleged possession of a wildlife trophy worth Sh 8.4 million. This legal entanglement arose from an incident on March 18 at a Petrol Station in Isinya town. Alongside others yet unidentified, Tukuo and Loishorua purportedly committed the offense, prompting their recent court appearance before Principal Magistrate Jane Kamau.

Charges and Denial

During their appearance in court, Tukuo and Loishorua vehemently denied the charges brought against them. However, the gravity of the allegations suggests the severity of the alleged offense, underscoring the importance of the legal proceedings.

Offense Details

The focal point of the case lies in the possession of 24 pieces of Elephant tusks, collectively weighing 56 kilograms and valued at Sh 8.4 million. These trophies, discovered during the defendants’ apprehension, shed light on the magnitude of the situation and the potential implications for the accused.

Transportation and Permit Issues

A noteworthy aspect of the case revolves around the transportation of the wildlife trophies. The items were reportedly transported using a motorcycle bearing the registration number KMFR 882. However, the absence of a requisite permit raises legal concerns regarding the possession and movement of such items.

Defense’s Application

Throughout the court proceedings, the defense counsel sought the recovery of specific items, including the motorbike and two mobile phones seized as part of the exhibit. This application underscores the legal maneuvering aimed at securing the release of confiscated possessions.

Objection by Investigating Officer

Despite the defense’s efforts, the investigating officer objected to the application, emphasizing the legality of the items’ confiscation. The officer highlighted the accused’s consent to the seizure and the ongoing forensic analysis of the mobile phones as crucial factors in the case.

Consent and Forensic Analysis

The accused’s consent to the confiscation plays a pivotal role in the legal proceedings, justifying the forensic analysis of the seized mobile phones. This analysis aims to gather additional evidence pertinent to the ongoing investigation, potentially influencing the outcome of the case.

Motorbike Release

Regarding the motorbike, the court advised the defense counsel to produce an affidavit for its potential release. This procedural requirement ensures a lawful process for the return of seized items, maintaining the integrity of the legal proceedings.

Court’s Direction

The magistrate presiding over the case directed that the matter proceed to a full hearing scheduled for June 18, 2024. This decision sets the stage for further legal proceedings, offering both the prosecution and defense an opportunity to present their respective cases comprehensively.
