It is bad news for businessman Mohamed Hassan Kini, who will now resort to public means, Bodaboda. If possible, he trekked after the High Court in Mombasa found that he, alongside his vehicle, was a drug peddler.
This came after a vehicle was found after he was arrested while ferrying Cannabis Sativa weighing 531 grammes, and some multiple of heroin worth Sh1.5 million was found inside the vehicle.
According to High Court Justice Lucy Njuguna, the motor vehicle was a proceed of crime, and it was directed to be forfeited to the state.

“The court therefore hereby issued declaring motor vehicle registration number KCV 894V, Daihatsu, station wagon as a proceed of crime and therefore directed that it be forfeited to the state,” ruled the judge.
The car was handed over to the Assets Recovery Agency (ARA) after the court order.
In court, the Director of the National Transport and Safety Authority was ordered to effect the transfer of the motor vehicle to ARA and was directed to comply with the said order.
The application by Al-alyaan Motors that sought the motor vehicle to be released to them, claiming that Kini defaulted on loan repayment, was blatantly rejected.
The court ruled that public interest militates against the release of the vehicle to Al-alyaan Motors as that would go against the spirit of the enactment of the POCAMLA.
The court noted Al-alyaan Motors and the purchaser was fraudsters who used the bank and the said vehicle to get into the drug business.
