Eun Yon, a foreign investor, has taken significant legal action against Chief David Nyandoro, the Lands Registrar, regarding a property dispute worth Sh400 million in Nairobi County.

The Case

Eun Yon, representing Holistic Mission for All Nations as a trustee, initiated legal proceedings against Jung Won, the Chief Land Registrar, and the Attorney General. The dispute revolves around the issuance of a title deed for property valued at Sh400 million in Muthaiga, Nairobi.

Initial Court Proceedings

Court documents reveal that Eun Yon approached the Milimani High Court on October 4, 2023, seeking the release of the title deed. Despite court orders directing the Chief Land Registrar to release the deed, compliance was not achieved.

Failure to Comply

Despite court directives and subsequent follow-ups, the Chief Land Registrar allegedly failed to release the title deed to Eun Yon. This non-compliance led to significant damages and legal complexities for the investor.

Seeking Justice

Eun Yon’s legal representative, Lawrence Nyangito, filed a contempt application against the Chief Land Registrar, highlighting the blatant disregard for court orders. The application seeks redress for damages suffered due to non-compliance.

Legal Ramifications

The contempt application calls for severe consequences, including the seizure and attachment of the Chief Land Registrar’s properties. Additionally, it requests the court declare the Registrar unfit for government service and to impose civil jail time.
